Definitions
Loadup Ltd, hereinafter
called 'the company', is solely an introductory service. The company
is NOT a freight forwarder and will not be responsible for arranging
all or any of the carriage, storage, packing, insurance or loading
of goods.
This Agreement
This document constitutes an agreement between the company and you,
the customer. From the date of our accepting this agreement, the
company agrees to provide you with access to this service.
You agree to make payments according to the terms of this agreement
The minimum contract term of this agreement is 3 months.
Note:
The 3 month minimum contract term
applies to new accounts only, existing subscribers may cancel and
renew at will.
License Grant
You are hereby granted a non-transferable,
non-sublicenseable, limited, revocable, right and license to access
and make use of the Website for your own exclusive benefit. If it
is intended that the Website and Information contained therein,
be used by users other than yourself, you will require a separate
account for each user.
Legal
The company shall not be liable to
the customer, owner or third party for loss or damage to any goods,
nor for any such loss or damage arising from any non-compliance
with the customer or owners instructions, or for any failure to
perform whether wholly or in part their obligations. It is the responsibility
of both parties (the customer & the owner) to arrange the delivery
of the goods. In no circumstances whatsoever shall the company be
liable to the customer or the owner for any loss, damage, cost or
expenses arising out of any person(s) relaying advice or information.
Disclaimer
The company is not liable for any
loss or expense incurred by you resulting from the use of this service,
whether due to any defects or otherwise.
The company does not warrant or guarantee the accuracy of content
of this service. The company has no responsibility for the warranty,
fitness for agents, and do not vouch for those companies or person(s)
and their organisation(s) whose services maybe displayed or referred
to by the company, nor for the availability or suitability of such
services. The company shall have neither liability nor responsibility
to any person(s) or organisation(s) with respect to any loss arising
from information or the use of information offered by the company.
Your Obligations
You will:
1: Not submit any material on this service which could be considered
unlawful or cause offence
2: Ensure that any information entered by you on to this service
is accurate and complies with relevant legislation
3: Indemnify us against any loss, damage or other expenses incurred
by us as a result of your use of this service
4. Not divulge your UserID and password to any unauthorised person
5. Neither make use of our service for the purpose of forwarding
nor re-advertise loads posted on Loadup on other freight exchanges.
Ending the Agreement
You may end this agreement at any
time but you must give us at least 24 hours notice by email or telephone,
notice not to expire before the minimum term of 3 months. Subscribers
paying by monthly rebilling of credit card, wishing to terminate
their futurepay agreement, must contact us at least 24 hours prior
to the next payment date, otherwise the payment would be taken by
Worldpay before the next opportunity to cancel a futurepay agreement.
On cancellation, the account will remain active for 31 days after
the last payment is made.

Alternatively, FuturePay agreements can be cancelled by logging
on to Worldpay Ltd at: http://www.worldpay.com/shopper/index.php?page=account
with the username and password supplied in the FuturePay confirmation
e-mail, following the cancellation instructions there.
Note for monthly rebilling subscribers: For subscriptions taken
out between the 27th and 31st day of the month, payments are taken
on the subsequent 26th to avoid invoicing errors spilling over into
the following month. No subscription days are lost, an account is
always active for 31 days after the original subscription day of
the month.
Use of cookies
A cookie is a small text file that
is placed on your computer's hard drive when accessing a Website.
It is an identification card, which is uniquely yours and can only
be read by the server that gave it to you. It cannot be used to
deliver computer viruses.
It is not recommended that you disable cookies on your computer
as this will have a negative impact on the service we provide.
Refund Policy
Refunds will be made at the discretion
of the management, in proportion to the length of time remaining
on an active account, subject to the minimum term of 3 months subscription
and 24 hours notice. Refunds are not made on monthly payment options.
On receiving notice to cancel a futurepay agreement, an account
will expire 31 days after the last monthly payment.

BARRING FROM THE SITE
The company reserves the right to
bar users from this site, on a permanent or temporary basis at our
sole discretion. Any such user shall be notified and must not then
attempt to use this site under any other name or through any other
user.
Copyright
The reproduction, copying, storage,
recording, broadcasting, retransmission or distribution of any part
of Loadup is not permitted.
