Loadup freight exchange terms and conditions of use for transporter companies.

Loadup®, is solely an introductory service, NOT a freight forwarder and will not be responsible for arranging all or any of the carriage, storage, packing, insurance or loading of goods. All arrangements or contracts, whether written or verbal are solely between the shipper and transporter. Loadup does not get involved with any part of this process
This document constitutes an agreement between Loadup and you, the transporter. From the date of our accepting this agreement, beginning when the first payment has been made, Loadup agrees to provide you with access to this service.
You agree to make payments according to the terms of this agreement
Please note that once you register yourself on the web site, you are deemed to have agreed to the terms and conditions set forth here. If you do not agree with these terms and conditions, you must not transact on this web site. Once you have registered and submitted your details to open an account on the registration page, you have entered into a formal agreement with Loadup for the purpose of transactions on this web site.
You are hereby granted a non-transferable, non-sublicenseable, limited, revocable, right and license to access and make use of the web site for your own exclusive benefit. If it is intended that the web site and Information contained therein, be used by users other than yourself, you will require a separate account for each user. Please note that transporters want immediate access which we provide by default, but as is the case with any other digital download, once a subscriber has gained access to the members area by making an initial payment and accessing any load details, this is deemed to be a digital download of valuable information to which we own the rights and we are unable to accept cancellation by way of refund of a subscription once downloading has commenced.
Loadup shall not be liable to the transporter, owner or third party for loss or damage to any goods, nor for any such loss or damage arising from any non-compliance with the transporter or owners instructions, or for any failure to perform whether wholly or in part their obligations. It is the responsibility of both parties (the transporter & the owner) to arrange the delivery of the goods and ensure adequate GIT insurance cover. In no circumstances whatsoever shall Loadup be liable to the transporter or the owner for any loss, damage, cost or expenses arising out of any person(s) relaying advice or information.
Loadup is not liable for any
loss or expense incurred by you resulting from the use of this service,
whether due to any defects or otherwise.
Loadup does not warrant or guarantee the accuracy of content of this service. Loadup has no responsibility for the warranty, fitness for agents, and do not vouch for those companies or person(s) and their organisation(s) whose services maybe displayed or referred to by the company, nor for the availability or suitability of such services. Loadup shall have neither liability nor responsibility to any person(s) or organisation(s) with respect to any loss arising from information or the use of information offered by the company. Loadup cannot be held responsible for the failure of email providers to accept emails from our server.
1: Not submit any material on this service which could be considered unlawful or cause offence.
2: Ensure that any information entered by you on to this service is accurate and complies with relevant legislation.
3: Indemnify us against any loss, damage or other expenses incurred by us as a result of your use of this service.
4. Not divulge your User ID and password to any unauthorised person.
5. As the subscribing transporter, it is your company alone which must undertake the delivery of any loads that you quote for obtained on our system and neither make use of our service for the purpose of forwarding loads listed on Loadup, nor re-advertising available work posted on Loadup on other freight exchanges, sub-contracting your own excess work to other members is allowed.
6. Behave professionally and courteously at all times in your dealings and communications with shippers.
All posts to the web site are moderated and scanned for discourteous / unprofessional language or attempts to subvert our service by diverting any user or traffic away from our service. See 'Barring from the site' below.
Ending the Agreement
You may end this agreement at any
time, not to expire
before the minimum term of 3 months, but you must give us at least 24 hours notice. Subscribers paying by monthly
rebilling of credit card, wishing to terminate their future pay agreement,
must contact us at least 24 hours prior to the next payment date,
otherwise the payment would be taken before the next opportunity
to cancel a monthly rebilling instruction.
Upon cancellation, the account will remain active for 31 days after the last payment was taken.
The 3 month minimum contract term applies to new subscribers only, existing subscribers may cancel and renew at will. Please wait until after a third monthly payment has been made before requesting cancellation.
In our efforts to make life simple for our subscribers, here are the two ways of cancelling a monthly rebilling (recurring transaction aka future pay agreement) subscription.
1/ Using the username and password supplied to you in the original future pay agreement confirmation email from WorldPay (not your Loadup user id and password).
Login to www.worldpay.com/shopper and cancel the agreement.
2/ Request cancellation by contacting our office, click the link below to contact admin, quoting your Loadup login User Id and password. As emphasised above we need a minimum of 24 hours notice before next payment is due to be taken.
We will supply you with a time-stamped reference number which you can print out for your proof of cancellation in case of any future disputes.
Do not attempt to contact Loadup or Worldpay to cancel by replying to a WorldPay email, their emails are "no reply".
You can be confident that by submitting your contact details to Loadup, they will never end up in the hands of other companies and that we will minimise our email reminders to no more than 1 reminder email in a 2 month period.
A key part of our service is email communications with our users. By using our service, you agree that we may send you emails, that you have elected to participate in our email program and that we may forward email messages to you.
A cookie is a small text file that
is placed on your computer's hard drive when accessing a web site.
It is an identification card, which is uniquely yours and can only
be read by the server that sent it to you. It cannot be used to

Refunds are not made on parts or fractions of
monthly rebilling payments. Upon cancellation of a monthly rebilling
instruction, an account will expire 31 days after the last payment.
The one-off payment options give substantial discounts in return for the agreement to commit to that period of subscription, refunds are therefore not considered.
We provide our paid subscription services only to transporter company businesses and by registering, even if you are a sole trader, you are a business user and the automatic cooling off periods for private consumers under the distance selling regulations do not apply.

Barring from the site
Loadup reserves the right to bar anyone abusing this site, on a permanent or temporary basis at our sole discretion.
Any such user must not then attempt to access this web site under another name or through any other user. Information regarding serious abuse is shared between other online transport providers.
